
FEDERAL TORT CLAIMS ACT
The Federal Tort Claims Act (FTCA) is a law passed by Congress to allow the United States to be sued for acts of its employees. It covers a number of things (property damage, personal injury, death, etc.), and excludes others (maritime acts, intentional wrongdoing, servicemen on active duty, discretionary acts by government employees).
The type of FTCA claim we can help with is medical malpractice by a Veterans Administration (VA) Hospital. We do not have the expertise to handle these cases in this office, but we have worked with a California based attorney who limits her practice to FTCA claims with great success. She once worked for the U.S., settling cases for them, and has a lot of experience with this type of claim. If a Veteran (or a dependent of active duty personnel) is treated below the minimum standards of medical care and serious injury results, an FTCA claim should be considered. Keep in mind that there is a two year statute of limitations with very few exceptions. Also understand that bad medical results do not mean bad care; medical procedures are often unsuccessful even when done correctly.
